1. Scope#
These terms apply to all contracts between [Firmenname / Inhaber:in] ("we") and our customers ("you") concluded via this website, including pick-up orders for café and bubble tea products and orders from our online shop. Deviating terms of customers do not apply.
2. Conclusion of contract#
The presentation of products on the website is not a binding offer but an invitation to order. By clicking “Order with obligation to pay” you submit a binding offer. The contract is concluded when we confirm the order by email or in your account.
3. Prices#
All prices are final prices in euros including statutory VAT. Shipping costs and deposits (Pfand) are shown separately before you order.
4. Pick-up orders#
Café and bubble tea orders are prepared fresh for the pick-up time you choose. Please collect them within 30 minutes of that time. Freshly prepared food and drinks cannot be returned (see the withdrawal policy).
5. Member account#
You must be at least 16 years old to open an account. Keep your login details secret. You may close your account at any time in the account settings. We may block accounts that are misused, for example to collect stamps fraudulently.
6. Liability#
We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are only liable for the breach of essential contractual obligations, limited to the foreseeable, typical damage.
7. Final provisions#
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not remove the protection of mandatory provisions of the law of their habitual residence.
